Wells said he approached Domi- nique with a gun and said, "Don't make me shoot you." Wells said Dominique indicated he had a gun and patted his waist area as if he had one, but he never saw Dominique with a gun. Wells said he was scared and that he started shooting, trying to aim at nonvital areas on Dominique's body.

Wells said he shot Dominique first in thearm, then in the chest and eventually in the back after he fell. Wells estimated he shot four or five times in all, adding that he did not intend to kill Dominique. Wells also said he aimed the gun at Dominique's father when he came toward Wells "like a raging bull." Henson argued, among other things, that Wells had a number of opportunities to avoid a confrontation with Dominique on the day in question, that Wells acted with malice and premeditation, that Wells continued to shoot Dominique after he had fallen the floor, that no one else at the crime scene besides Wells was found to have a gun and that there were inconsistencies in Wells' testimony. Reynolds tried to challenge those claims, arguing Wells did not act with malice but acted in the heat of the moment and in self-defense. She also pointed out that Dominique was younger, taller and weighed more than Wells.
